Abstract
تجسدت معالم الحماية القانونية لحق الإنسان في بيئة سليمة على المستوى الداخلي بتبنيها من سائر دول العالم مع تباين واضح في المقاربات التي أخذت بها تلك الدول في نظمها القانونية بشأن إعطاء هذا الحق المكانة الدستورية أو الاكتفاء بالحماية التشريعية، وهي المقاربات التي نهدف إلى إبرازها من خلال هذه الدراسة. إذ يعتبر حق الإنسان في بيئة سليمة من أهم الحقوق في مجال الحقوق والحريات العامة، وهو ينتمي للجيل الثالث لحقوق الإنسان، ويقوم هذا الحق على فكرة وجوب التضامن بين الشعوب من منطلق أنه لا يمكن القضاء على مضار البيئة في غياب الحماية القانونية لهذا الحق. وقد تحددت معالم الحماية القانونية لحق الإنسان في بيئة سليمة على المستوى الدولي من خلال عدة محطات دولية توجت بعديد الصكوك التي تعنى بالبيئة، يعتبر مؤتمر ستوكهولم للبيئة الإنسانية المنعقد سنة 1972 أولها، ومن بعده مؤتمر ريو دي جانيرو 1992، إضافة إلى العديد من المؤتمرات الدولية الإقليمية والعالمية التي تعنى بموضوع البيئة. الكلمات المفتاحية: الحماية القانونية، البيئة، حقوق الإنسان، الدساتير ، التشريعات البيئية
The legal protection of the human right to a healthy environment has materialized domestically through the adoption of the latter by most states despite the apparent differences between the approaches on which it is based. their legal systems, with a view to giving this right a constitutional framework or the satisfaction of legislative protection, the approaches that we wish to highlight through this study. The human right to a healthy environment, part of the third generation of human rights, is of major importance in the context of public rights and freedoms. This right is based on the principle of solidarity between peoples, considering that we cannot put an end to environmental damage in the absence of legal protection of the environment. The broad outlines of the legal protection of the human right to a healthy environment have been established at the international level through several international meetings, starting with the Stockholm conference held in 1972, then the Rio De Janeiro summit in 1992, in plus various regional or international congresses and conferences, which are interested in the subject of the environment.
