Abstract
يقتضي للمحافظة على الصحة العامة اتخاذ كل الإجراءات اللازمة لمواجهة أي مرض ناقل للعدوى لحماية صحة الأفراد، وهو مااتخذته مختلف التشريعات التي جمعت بين الجانب الوقائي لمواجهة انتشار فيروس كورونا – covid 19 والجانب الردعي وذلك بتقرير عقوبات على كل من خالف هذه التدابير وتحميله المسؤولية الجزائية، وانطلاقا من ذلك انتهج المشرع الجزائري سياسة جنائية تجمع بين الآليات الوقائية والقمعية قصد إحداث سياسة ناجعة لمواجهة الوباء.
