| dc.description.abstract | يُعتبر الضبط الإداري وسيلة تنظيمية تعتمدها السلطة الإدارية بهدف تحقيق توازن بين حرية الأفراد ومتطلبات النظام العام، بالإضافة إلى حماية المصلحة العامة داخل المجتمع، إلا أن هذه الصلاحيات لا تُمارس بشكل مطلق، بل تقع تحت طائلة جملة من الضوابط القانونية التي ترمي إلى صون الحقوق والحريات الفردية وضمان احترام سيادة القانون، خاصة في الأوضاع العادية وفق ما يقرره التشريع الجزائري. ويُعتبر مبدأ المشروعية من أبرز هذه الضوابط، بل يُلزم الإدارة بعدم الخروج عن أحكام القانون في جميع تصرفاتها. وفي هذا السياق تلعب الرقابة القضائية دورًا محوريًا حيث تتولى فحص مدى مطابقة القرارات الإدارية لشروط المشروعية من حيث الجهة المختصة، والشكل، والإجراءات المعتمدة.Administrative policing is considered a regulatory tool adopted by the administrative authority with the aim of achieving a balance between individual freedoms and the requirements of public order, in addition to protecting the public interest within society. However, these powers are not exercised absolutely; rather, they are subject to a set of legal constraints intended to safeguard individual rights and freedoms and ensure respect for the rule of law—especially under normal circumstances as established by Algerian legislation. The principle of legality is among the most prominent of these constraints, obligating the administration to adhere to the provisions of the law in all its actions.
