| dc.description.abstract | تتناول هذه الد ا رسة المركز القانوني للحكومة في ظل التعديل الدستوري الجزائري لسنة 2020 ، وذلك في إطار تخصص دولة ومؤسسات. وتنطلق من إشكالية رئيسية مفادها: إلى أي مدى أسهم التعديل الدستوري لسنة 2020 في إعادة تحديد المركز القانوني للحكومة وتعزيز مكانتها داخل منظومة السلطة التنفيذية؟ وللإجابة عن هذه الإشكالية، تم الاعتماد على المنهج الوصفي التحليلي في قراءة النصوص الدستورية، مع توظيف المنهج المقارن عند الاقتضاء. وقد خلصت الد ا رسة إلى أن الحكومة في ظل الدساتير السابقة كانت تعاني من تبعية واضحة لمؤسسة رئيس الجمهورية على المستويين العضوي والوظيفي، وأن تعديل 2020 استحدث تنظيماً جديداً يقوم على ثنائية الوزير الأول و رئيس الحكومة وفقاً لطبيعة الأغلبية البرلمانية، إلا أنه لم يُحدث تحولاً جذرياً في موازين القوى داخل السلطة التنفيذية، إذ لا تزال مؤسسةالرئاسة تهيمن على توجيه العمل الحكومي.This study examines the legal status of the government under Algeria’s 2020 constitutional amendment, within the framework of the study of the state and its institutions. It addresses a central question: to what extent did the 2020 constitutional amendment contribute to redefining the government's legal status and strengthening its position within the executive branch? To answer this question, the study employs a descriptive-analytical approach to examine constitutional texts, while utilizing a comparative approach where appropriate. The study concludes that, under previous constitutions, the government was clearly subordinate to the institution of the President of the Republic—both structurally and functionally. Although the 2020 amendment introduced a new arrangement based on a duality between the "First Minister" and the "Head of Government," depending on the nature of the parliamentary majority, it did not bring about a radical shift in the balance of power within the executive branch; the presidency continues to dominate the direction of government action. | |
