Abstract
في اطار تجسيد الحكومة الالكترونية ومسايرة التطور التكنولوجي الذي تشهده مختلف دول العالم قامت الدولة الجزائرية في سنة 1999 الستحداث لجنة وطنية إلصالح العدالة بموجب مرسوم رئاسي التي عملت على اجراء عملية دراسة وتشريع دقيق لواقع العدالة في الجزائر ، خرجت بمجمو عة من التوصيات التي تضمنت عدة بنود منها العمل على عصرنة قطاع العدالة اين تم استحداث مديرية بذات العصرنة سميت بمديرية عصرنة العدالة للتوالى بعد المتعلق بعصرنة العدالة والقانون 03-15 ذلك صدور مجموعة من القوانين أهمها قانون 04- 15 المتعلق بالتوقيع والتصديق االلكترونين وقد تمكن قطاع العدالة من قطع اشواط متقدمة في مجال تكنولو جيات االعالم واالتصال والتحول نحو العالم الرقمي إذ تم تجسيد عديد المشاريع بغية الوصول الى عدالة عصرية بمعايير دولية ونتناول من خالل هذه المداخلة التجربة الجزائرية في تجسيد المحكمة الالكتروني وفقا لمبحثين ، الاول : يتناول النيابة الالكترونية في النظام القضائي الجزائري والاجراءات المتبعة في ذلك وفي المبحث الثاني النيابة الالكترونية في النظام القضائي النظام القضائي الجزائري عن طريق تعريفها وشروطها ودورها في ظل جائحة كرونا
Within the framework of embodying electronic government and keeping pace with the technological development witnessed by various countries of the world, the Algerian state, in 1999, established a national committee for justice reform, in accordance with a presidential decree, which worked to conduct a process of careful study and legislation of the reality of justice in Algeria. It came out with a set of recommendations that included several items, including: Working to modernize the justice sector. Where was a directorate created with the same modernity, named the Directorate of Modernization of Justice, respectively, after relating to the modernization of justice and Law 03-15. This is the issuance of a group of laws, the most important of which is Law 04-15 relating to electronic signature and authentication. The justice sector has been able to make advanced strides in the field of electronic technology. Media, communication and the shift towards the digital world, as many projects have been implemented in order to reach modern justice with international standards. Through this intervention, we discuss the Algerian experience in embodying the electronic court according to two sections. The first: deals with the electronic prosecution in the Algerian judicial system and the procedures followed in that, and the second section deals with the electronic prosecution. In the judicial system, the Algerian judicial system through its definition, conditions, and role in light of the Corona pandemic
