| dc.description.abstract | تتناول الدراسة مفهوم العدالة التصالحية كنهج بديل للنظام العقابي التقليدي في التعامل مع الجرائم. يهدف هذا النوع من العدالة إلى جبر الضرر الذي لحق بالضحايا وإعادة تأهيل الجاني من خلال الحوار والتفاهم، بدلاً من العقوبات القاسية كالسجن. وينصب التركيز على مسؤولية الجاني عن أفعاله وضرورة تحمل عواقب ما فعله، إما بتعويض الضحية أو تقديم اعتذار رسمي. كما تسعى العدالة التصالحية إلى تخفيف التوترات الاجتماعية وتعزيز التماسك المجتمعي. وهي مناسبة بشكل خاص للجرائم البسيطة أو تلك التي لا تتطلب عقوبات صارمة، ويشمل تطبيقها المجتمع بأكمله، بما في ذلك الضحية والجاني، وأحيانًا أفراد المجتمع المحيط. تناقش الرسالة التجارب الدولية في تطبيق العدالة التصالحية، وتقدم أفكارًا لتطبيقها المحتمل في النظام القضائي المحلي.The study examines the concept of restorative justice as an alternative approach to the traditional penal system for dealing with crimes. This type of justice aims to redress the harm done to victims and rehabilitate the perpetrator through dialogue and understanding, rather than harsh punishments such as imprisonment. The focus is on the perpetrator's responsibility for their actions and the need to bear the consequences, either by compensating the victim or offering a formal apology. Restorative justice also seeks to ease social tensions and promote community cohesion. It is particularly appropriate for minor crimes or those that do not require severe penalties, and its application involves the entire community, including the victim, the perpetrator, and sometimes members of the surrounding community. The thesis discusses international experiences in the application of restorative justice and offers ideas for its potential application in the local judicial system. | |
