| dc.description.abstract | تعتبر الشروط الاستثنائية غير المألوفة من المعايير التي استقر الفقه والقضاء الاداري عليها في تمييز العقد الإداري، كما يعتبر شرط الثبات التشريعي شرط استثنائي على القواعد العامة تضعه الدول في عقودها الادارية ذات الطابع الدولي،من اجل جذب الاستثمارات الاجنبية ، هذا الاخير الثي اثار الجدل حول مدى اعتباره من قبيل الشروط الاستثنائية غير المألوفة في القانون الخاص والتي تضفي الطبيعة الإدارية على العقد الإداري ـأو تنفيها. الكلمات المفتاحية: الشروط الاستثنائية غير المالوفة، شرط الثبات التشريعي، العقد الإداري، معايير تمييز العقد الاداري، المعيار القضائي.
