Abstract
الأجنبي هو شخص غير وطني غير مرتبط بجنسية البلد الذي يقيم فيه، عرفه المشرع الجزائري في المادة 03 من القانون 08-11 المتعلق بشروط دخول الأجانب وإقامتهم وتنقلهم إلى الجزائر، وينص على أن: "الأجنبي يعتبر فردا يحمل جنسية غير الجنسية الجزائرية أو من لا يحمل أية جنسية". ويلاحظ من هذا المقال أن الأجنبي ينقسم إلى فئتين، الفئة الأولى من يحمل جنسية دولة أخرى، والفئة الثانية عديمي الجنسية. للدولة حرية تحديد الوضع القانوني للأجانب المقيمين على أراضيها، لكن حريتها مقيدة بمجموعة من القيود العامة تتمثل بشكل أساسي في الحد الأدنى من حقوق المعاملة للأجانب، وقيود أخرى خاصة تتعلق بالأوضاع الداخلية للدولة. ولاية. ويمكن رفع الحد الأدنى من حقوق المعاملة للأجانب من خلال الاعتماد على مجموعة من الوسائل والمبادئ، وهي: مبدأ المعاملة بالمثل، ومبدأ مساواة الأجانب بالرعايا، ومبدأ الدولة الأكثر رعاية. تنظم الدولة الجزائرية وضعية الأجانب داخلها، فنجد أنها وضعت إجراءات مختلفة للأجانب عند دخولهم إلى الجزائر، مثل وجوب حمل جواز سفر وتأشيرة، وكذلك شروط إقامتهم، المقيم والأجنبي ملزم بحمل بطاقة الإقامة، كما أن خروجهم من الجزائر أيضا، مهما كان نوع خروجهم، يكون اختياريا بالنسبة للأجنبي، أو إجباريا حيث تجبر الدولة الأجنبي على المغادرة. يستطيع الأجنبي بمجرد دخوله وإقامته أن يتمتع بمجموعة من الحقوق العامة والخاصة التي تدخل ضمن الحد الأدنى من حقوق معاملة الأجانب، إلا أن تمتعهم بهذه الحقوق يجعلهم ملزمين بالتزامات مالية وغيرها من الالتزامات غير المالية أيضاً. أما التبعية المدنية التي ألزمتهم بها الدولة، وذلك للحفاظ على أمنها واستقرارها الداخلي، فمن غير المعقول أن يتمتع الأجانب بكل هذه الحقوق وليس عليهم أي واجبات في حقهم، لأن هذا يضعهم في وضع أفضل. من المواطنين، وهذا ما تسعى الدولة إلى تجنبه.
A foreigner is a non-national person who is not bound by nationality to the country which he resides, the Algerian legislator defined it in article 03 of law 08-11 related to the conditions for entry, residence and movement of foreigners into Algeria, which stipulates that: “A foreigner is considered an individual who holds a nationality other than the Algerian nationality or the one who does not have any nationality”. It is noted from this article that the foreigner is divided into two categories, the first category is the one who holds the nationality of another country, and the second category is stateless. The state is free to determine the legal status for foreigners residing on its territory, but its freedom is restricted by a set of general restrictions mainly represented in the minimum level of treatment rights for foreigners, and other special restrictions related to the internal conditions of the state. It can raise the minimum level of treatment rights for foreigners by relying on a set of means and principles, namely: the principle of reciprocity, the principle of assimilation of foreigners to nationals, and the principle of the most favored state. The Algerian state regulates the status of foreigners within it, so we find that it has set various procedures for foreigners when they enter Algeria, such as the obligation to hold a passport and a visa, as well as the conditions of their residence, the resident foreigner is obligated to carry a resident card, and their exit from Algeria also, whatever the type of their exit, is optional on the part of the foreigner, or obligatory as the state forces the foreigner to leave. As soon as the foreigner enters and resides, he is able to enjoy a set of public and private rights that fall within the minimum rights of treatment of foreigners, except that their enjoyment of these rights makes them obligated to financial and other nonfinancial obligations as well as to civil dependence, which the state obliged them to, and this is to maintain its internal security and stability, it is unreasonable for foreigners to enjoy all these rights and not have any duties in their right, because this puts them in a better position than the citizens, and this is what the state seeks to avoid.
