| dc.description.abstract | شهدت الجزائر حدثًا تاريخيًا هامًا، مثّل نقطة انطلاق لبناء مؤسسات جديدة. وقد انعكس ذلك في التعديل الدستوري لعام 2020 بإنشاء محاكم الاستئناف الإدارية. وقد لعبت هذه المحاكم دورًا هامًا في تخفيف العبء عن المتقاضين الذين كانوا يضطرون سابقًا إلى اللجوء إلى مجلس الدولة لتقديم الطعون. وقد أحدث هذا التعديل تغييرًا جذريًا في النظام القضائي الجزائري، معززًا الحماية والرقابة القانونية لتعزيز الحقوق والحريات. وكان من أهم الإجراءات التي أدخلها المشرع الجزائري خلال تعديل قانون الإجراءات المدنية والإدارية. ففي السابق، كانت الطعون في المسائل الإدارية تُدار حصريًا من قِبل مجلس الدولة، مما شكل عبئًا على المتقاضين نظرًا لبعده عن السلطة القضائية. وقد سعى المشرع إلى معالجة هذا الوضع من خلال تقريب العدالة من المواطن.Algeria witnessed a significant historical event, which represented a starting point for the development of new institutions. This was reflected in the 2020 constitutional amendment establishing administrative courts of appeal. These courts played a significant role in alleviating the burden on litigants who previously had to resort to the Council of State to file appeals. This amendment radically changed the Algerian judicial system, strengthening legal protection and oversight to promote rights and freedoms. One of the most important measures introduced by the Algerian legislature was the amendment of the Code of Civil and Administrative Procedure. Previously, appeals in administrative matters were exclusively handled by the Council of State, which posed a burden on litigants due to its remoteness from the judiciary. The legislature sought to address this situation by bringing justice closer to citizens. | |
