| dc.description.abstract | تنشأ المسؤولية التعاقدية بمجرد إخلال أحد طرفي العقد بالالتزامات، سواء اتخذ هذا الإخلال شكل عدم التنفيذ أو التأخير فيه. يحق للطرف المتضرر المطالبة بالتعويض عن الضرر الذي لحقه من خلال دعوى المسئولية العقدية، والهدف من هذا التعويض هو جبر الضرر، والأصل أنه قضائي، والقاضي هو من يقدره، ولكن لا يفعل ذلك. ولا يمنع المتعاقدين من تقديره. وبما أن العقد هو قانون المتعاقدين فقد أجاز المشرع الجزائري للمتعاقدين الاتفاق على تعديل أحكام المسؤولية التعاقدية سواء بالإعفاء أو التخفيف أو التشديد في حدود القانون كما نصت المادة 178 من هذا القانون. القانون المدني الجزائري. Contractual liability arises once the obligations are breached by one of the parties to the contract, whether this breach takes the form of non-implementation or delay in it. The aggrieved party has the right to claim compensation for the damage incurred through the contractual liability lawsuit, and the aim of this compensation is reparation, and the principle is that it is judicial, and the judge is the one who estimates it, but that does not prevent the contracting parties from assessing it. And since the contract is the law of the contracting parties, the Algerian legislator authorized the contracting parties to agree to amend the provisions of contractual liability, whether by exemption, mitigation, or stress within the limits of the law, as stipulated in Article 178 of the Algerian Civil Code. | |
