Abstract
نظرية الضرورة في القانون الدستوري بوجه عام من الأفكار الدستورية الهامة التي طبقتها السلطات الحاكمة في الدول القديمة والمعاصرة، وتعرض لها الفقهاء بالبحث، رغم ندرة الدراسات الأكاديمية والأطروحات الجامعية التي تناولت الموضوع بمنهج علمي دقيق يقوم الباحث من خلاله بعملية جمع واستقراء وتحليل الأفكار التي توصل إليها الفقهاء ومن ثم القيام بعملية تأسيس لهذا الموضوع باعتباره مرتبطا بطبيعة النظام الدستوري والقانوني لكل دولة. ومن هنا تكمن أهمية وضرورة البحث في هذه النظرية التي خصصناها بإطار القانون الدستوري الجزائري، باعتبار أن هذه الدراسة ستجلب في تصورنا انتباه الباحثين في هذا التخصص لاختيار موضوع جدير بالبحث ومن الصعوبة بمكان إيجاد دراسات جادة فيه ولا سيما في المكتبات الجامعية والكليات والمعاهد المتخصصة، ومن جهة أخرى فإننا نحاول رسم خطة أولية للموضوع تنير طريق الباحث من خلال هذا المقال المتواضع للبناء عليها والانطلاق في دراسة هذه النظرية بشكل مفصل وبمنهج علمي مقبول.
The theory of necessity in constitutional law in general is one of the important constitutional ideas that have been applied by the ruling authorities in ancient and contemporary countries, and have been researched by jurists, despite the scarcity of academic studies and university dissertations that have dealt with the subject with a precise scientific approach through which the researcher undertakes the process of collecting, extrapolating and analyzing the ideas reached by jurists. Then carry out the process of establishing this topic as it is linked to the nature of the constitutional and legal system of each country. Hence lies the importance and necessity of researching this theory that we have allocated within the framework of Algerian constitutional law, given that this study will, in our view, attract the attention of researchers in this specialty to choose a topic worthy of research, and it is extremely difficult to find serious studies on it, especially in university libraries, colleges, and specialized institutes. On the one hand, In addition, we are trying to draw a preliminary plan for the topic that will illuminate the researcher’s path through this humble article to build on it and begin studying this theory in detail and with an acceptable scientific method.
