dc.description.abstractإهتم القانون الإنساني بمسألة حرية التعبير كحق من حقوق الإنسان، نظرا لأهميته البالغة التي يؤديها في أيٍ من المجالات و في كل الظروف و الأوقات على المستويين الداخلي و الدولي، و كون أن الطرف الأهم في معادلة الحق في حرية التعبير هي وسائل الإعلام باعتبارها تمثل عديد المؤسسات الإعلامية التي تتبعها، و كون أن العمل الإعلامي يفرض على الصحفيين الوصول إلى مصادر الخبر و الحصول على المعلومات التي تلبي فضول الرأي العام في معرفة الجديد حول أيٍ من المسائل التي تهمه، فإنهم بذلك -الصحفيون- يتعرضون لمخاطرجمة تعكس صعوبة الآداء الإعلامي رغم مشروعيته. و مشروعية العمل الصحفي المبنية أساسا على الحق في التعبير و حرية الإعلام عبر وسائله المختلفة تثيرموضوعا جدير بالإهتمام، استدعت الوقوف عنده و البحث فيه نظرا لخطورته على أمن المؤسسات الإعلامية؛و هي مسـألة "خطاب الكراهية في وسائل الإعلام"، التي أثرَّت سلبا على المعنى الحقيقي لحرية التعبير من جهة، و على مضمون الحماية التي توفرها القوانين الدولية للمؤسسات الإعلامية زمن النزاعات المسلحة. Humanitarian law pays attention to the issue of freedom of expression as a human right, due to the extreme importance it plays in any field and in all circumstances and times at the internal and international levels, and the fact that the most important party in the equation of the right to freedom of expression is the media, as they represent many institutions. The media work that you follow, and since media work requires journalists to access news sources and obtain information that satisfies public opinion’s curiosity in knowing what’s new about any of the issues that interest it, they - journalists - are exposed to critical risks that reflect the difficulty of media performance despite its legitimacy. The legitimacy of journalistic work, which is based primarily on the right to expression and freedom of the media through its various means, raises an issue worthy of attention, which necessitated consideration and research due to its danger to the security of media institutions. It is the issue of “hate speech in the media,” which has negatively affected the true meaning. On the one hand, for freedom of expression, and on the content of the protection provided by international laws to media institutions in times of armed conflict.
