| dc.description.abstract | تعتبر البيئة من أهم حقوق الانسان، لكون الانسان يعيش فيها كي تستمر حياته وحياة كل الكائنات الحية، لكن وبالرغم هذه الأهمية القصوى للبيئة بكافة عناصرها، إلا أنها تتعرض لانتهاكات مستمرة ، سواء زمن السلم أو زمن الحروب و النزاعات المسلحة حيث يستخدم الاسلحة المحرمة دوليا، دون مراعاة لأدنى مبدأ من مبادئ القانون الدولي الانساني بشقيه العرفي و الإتفاقي ولا للإنسانية ،مما يعجل بتدمير البيئة الطبيعية وانتشار التلوث و انتهاك الحق في بيئة نظيفة بوصفه حق من حقوق الانسان وعليه فالاشكالية المطروحة هي:ما نوع الحماية التي تتمتع بها البيئة زمن الحروب و النزاعات المسلحة ؟ The environment is considered one of the most important human rights, because man lives in it in order to continue his life and the lives of all living creatures, but despite this paramount importance of the environment with all its elements, it is exposed to continuous violations, whether in times of peace or times of wars and armed conflicts, where he uses internationally prohibited weapons, without Taking into account the minimum principle of international humanitarian law, both customary and convention, nor humanity, which accelerates the destruction of the natural environment, the spread of pollution, and the violation of the right to a clean environment as a human right ?. | |
