| dc.description.abstract | نظراً لأهمية العقارات وارتفاع مستوى النزاعات المحيطة بها، تم تخصيص اهتمام خاص لوضع قواعد محددة لإثبات الملكية العقارية، خلال فترة انتقالية من النظام الشخصي إلى النظام العيني، شهدت وسائل إثبات الملكية تنوعاً، وتطبيق قانون التوثيق كان جزءاً من هذه العملية. بالرغم من أن قانون التوثيق اشترط الرسمية في العقود التي تؤكد الملكية العقارية، فإن القضاء الجزائري كان يظهر تبايناً في تفسيره وتطبيقه في بعض الحالات، هذا التباين سبب اضطراباً في الثقة بالقطاع العقاري وتصاعد النزاعات التي كانت تستغرق وقتاً طويلاً لحلها. ومع ذلك، تم توحيد الموقف القانوني في النهاية، مع التأكيد على بطالة العقود العرفية وضرورة الرسمية في إثبات الملكية العقارية. high level of litigation surrounding it, special attention was paid to establishing specific rules to prove real estate ownership. Although the law on notarization required formality in contracts confirming real estate ownership, the Algerian judicial system showed divergences in its interpretation and application in some cases. This gap caused a shaken confidence in the real estate sector and an escalation of disputes that took a long time to be resolved. However, the legal situation was finally consolidated, highlighting the invalidity of customary contracts and the need for formality to prove real estate ownership. | |
