| dc.description.abstract | الملخص : يواجه العلم العقابي الحديث مشكلة العودة إلى الإجرام، الأمر الذي دفع علماء الإجرام والمعاقبين إلى إيجاد أسباب عودة المجرم إلى جريمته وتقديم الحلول لها. وقد أدرج المشرع الجزائري تعريف العود وشروطه وحالاته في قانون العقوبات. وهو بدوره سعى جاهدا لإيجاد حلول للقضاء عليه من خلال تطوير آليات لمكافحته، سواء في أحكام قانون العقوبات باعتباره ظرفا مشددا، أو في قانون تنظيم السجون و إعادة الإدماج الاجتماعي للمحبوسين من خلال العقوبات البديلة الواردة فيه. Abstract : modern punitive science is confronted with the problem of return to crime, which has prompted criminologists and punishers to find the reasons for the criminal's return to his crime and to provide solutions. The Algerian legislator has included the definition of recidivism, its conditions and its cases in the Penal Code. In turn, it has endeavored to find solutions to eliminate it by developing mechanisms to combat it, whether in the provisions of the Penal Code as an aggravating circumstance, or in the regulations of prisons and the law of social reintegration of detainees through the alternative penalties contained therein. | |
