| dc.description.abstract | تهدف هذه الدراسة إلى تسليط الضوء على جريمة الإهمال الأسري، باعتبارها من الجرائم التي تهدد بشكل مباشر استقرار وتماسك الأسرة، الوحدة الأساسية للمجتمع. وقد تناول المشرع الجزائري هذه القضية في قانون العقوبات، وتحديدًا في المواد من 330 إلى 332، بتجريم الأفعال التي تعكس تقصير أحد الوالدين ماديًا أو معنويًا. ويتجلى الإهمال المادي في رفض تقديم الدعم المالي، مما قد يؤدي إلى عواقب اجتماعية وخيمة كالحرمان وتفكك الأسرة. من ناحية أخرى، يتجلى الإهمال المعنوي في هجر منزل الزوجية، أو إهمال الزوجة الحامل، أو التقصير في رعاية الأطفال. ويولي القانون هذا النوع من الإهمال أهمية بالغة نظرًا لتأثيره المباشر على الطفل، الذي يُعتبر محور الحماية القانونية في مثل هذه الحالة. وقد أظهرت الدراسات الحديثة وجود صلة قوية بين غياب الرعاية الأسرية وجنوح الأحداث، مما يؤكد أهمية التدابير الوقائية، وأبرزها إنشاء مراكز إرشادية تضم متخصصين في علم اجتماع الأسرة، لتقديم المشورة للأزواج المخطوبين وغرس الشعور بالمسؤولية والالتزام تجاه أطفال المستقبل في نفوسهم.This study aims to shed light on the crime of family neglect, as it directly threatens the stability and cohesion of the family, the basic unit of society. Algerian legislators have addressed this issue in the Penal Code, specifically in Articles 330 to 332, criminalizing acts that reflect the material or moral negligence of a parent. Material neglect manifests itself in the refusal to provide financial support, which can lead to dire social consequences such as deprivation and family disintegration. On the other hand, moral neglect manifests itself in abandoning the marital home, neglecting a pregnant wife, or failing to care for children. The law attaches great importance to this type of neglect due to its direct impact on the child, who is considered the focus of legal protection in such cases. Recent studies have shown a strong link between the absence of family care and juvenile delinquency, underscoring the importance of preventative measures, most notably the establishment of counseling centers staffed with family sociology specialists to provide advice to engaged couples and instill in them a sense of responsibility and commitment towards their future children. | |
