| dc.description.abstract | يعتبر حق الإضراب من الحقوق الأساسية المكفولة للموظفين في الجزائر، وقد تم تنظيمه ضمن إطار قانوني يوازن بين حماية حقوق العمال وضمان استمرارية المرفق العامة والذي كان مجرد مطالبات بالحقوق والتي لاقت رفضا قاطعا وفي الحضارات القديمة ولم يظهر بصورته الحالية إلا مع التطور الاقتصادي، لذلك أوجب على الدولة تحديد إطار قانوني وتنظيمي لممارسة حق الإضراب دون التعسف من الأطراف سواء العمال أو الموظفين أو المؤسسة المستخدمة والإدارة العمومية، فنجد بأن المشرع الجزائري كرس هذا الحق دستوريا والاعتراف به للعمال للمطالبة بحقوقهم كما قام بتوقيع جزاءات نتيجة لعدم احترام هذه الضوابط والإجراءات الممارسة حق الإضراب.The right to strike is considered a fundamental right guaranteed to employees in Algeria. It has been regulated within a legal framework that balances the protection of workers' rights and the continuity of public services. This right was once merely a demand for rights, met with categorical rejection in ancient civilizations, and only emerged in its current form with economic development. Therefore, the state is obligated to establish a legal and regulatory framework for exercising the right to strike without abuse by any party, whether workers, employees, the employing institution, or the public administration. We find that the Algerian legislature has constitutionally enshrined this. right and recognized it for workers to demand their rights. | |
