| dc.description.abstract | يعد التعمير كفرع تطبيقي من القانون الإداري يعتني بتطور المدينة وإقليمها، الأمر الذي يجعله ميداناً خصب لتدخُلِ المشرع العمراني في كل مناسبة لتصحيح الاختلالات التي يشهدها النسيج العمراني من جهة ومواكبة المستجدات التي يعرفها عالم المعرفة والتقنية من جهة أخرى. وتهدف هذه المقالة الإحاطة بأهم الإصلاحات في باب التشريع والتنظيم من خلال طرح إشكالية: هل الإصلاحات في باب التعمير جزئية خاصة بقطاع معين ليس إلا؟ الإجابة لا، فالإصلاحات قائمة وشاملة ومستمرة بغية اللحاق بمستجدات القانون المقارن في جميع مجالات التعمير والتهيئة العمرانية. Urbanism is considered an applied branch of administrative law that takes care of the development of the city and its region, which makes it a fertile field for the intervention of the urban legislator at every opportunity to correct the imbalances witnessed in the urban fabric on the one hand and keep pace with the developments known in the world of knowledge and technology on the other hand. This article aims to cover the most important reforms in the field of legislation and regulation by raising a problem: Are the reforms in the field of construction partial and specific to a specific sector only? The answer is no, as reforms are ongoing, comprehensive and ongoing in order to catch up with developments in comparative law in all areas of reconstruction and urban planning. | |
