| dc.description.abstract | The memorandum provides a comprehensive study of sentencing alternatives and alternative punishments in Algerian legislation, focusing on the extent to which the legislator has succeeded in establishing penal systems that achieve reform and deterrence while addressing the challenges of prison overcrowding and promoting social reintegration. It analyzes traditional systems such as suspension of sentence execution and conditional release, as well as modern ones like community service and electronic monitoring, while drawing on comparative experiences such as judicial probation. The study highlights the flexibility of these systems and their adaptability to the nature of crimes, despite challenges including resource shortages and legal gaps. It concludes with findings emphasizing the importance of strengthening infrastructure and legislation, alongside proposals to expand the scope of application and adopt globally inspired models tailored locally to support modern criminal policy.تُقدّم المذكرة دراسةً شاملةً لبدائل العقوبات والعقوبات البديلة في التشريع الجزائري، مُركّزة على مدى نجاح المُشرّع في إرساء أنظمة جزائية تُحقّق الإصلاح والردع، وتُعالج تحديات اكتظاظ السجون وتُعزّز إعادة الإدماج الاجتماعي. وتُحلّل المذكرة الأنظمة التقليدية، كتعليق تنفيذ العقوبة والإفراج المشروط، بالإضافة إلى الأنظمة الحديثة، كالخدمة المجتمعية والمراقبة الإلكترونية، مُستندةً إلى تجارب مُقارنة، كالمراقبة القضائية. وتُسلّط الدراسة الضوء على مرونة هذه الأنظمة وقدرتها على التكيّف مع طبيعة الجرائم، رغم التحديات التي تُواجهها، بما في ذلك نقص الموارد والثغرات القانونية. وتُختتم الدراسة بنتائج تُؤكّد على أهمية تعزيز البنية التحتية والتشريعات، إلى جانب مقترحات لتوسيع نطاق التطبيق واعتماد نماذج مُستوحاة من التجارب العالمية ومُصمّمة محليًا لدعم السياسة الجنائية الحديثة. | |
