| dc.description.abstract | نشأت القرارات الإدارية المنفصلة في بداية القرن العشرين، بتحريض من مجلس الدولة الفرنسي، عقب بلورة موقف بشأن تطبيق شرط انتفاء الدعوى الموازية لقبول دعوى الإبطال. في البداية، رفض المجلس قبول دعوى الإبطال في القرارات الإدارية المعقدة، أي تلك المتعلقة بالإجراءات الإدارية القانونية التي تندرج منازعاتها ضمن اختصاص هيئات قضائية عادية أو إدارية غير الهيئة القضائية المختصة. إن تطبيق هذه النظرية عادل وصحيح. فتطبيقها الصحيح على النظام القضائي الجزائري يزيل المحاولات الخاطئة والمستحيلة لتطبيق شرط انتفاء الدعوى الموازية المنصوص عليه في المادة 276 من قانون الإجراءات المدنية الجزائري لقبول دعوى الإبطال. وهذا ما دفع المشرع الجزائري إلى حذف ذكره في قانون الإجراءات المدنية والإدارية الجديد.Separate administrative decisions emerged at the beginning of the twentieth century, at the instigation of the French Council of State, following the formulation of a position on the application of the condition of non-existence of parallel action to the admissibility of an annulment claim. Initially, the Council refused to accept an annulment claim in complex administrative decisions, i.e., those relating to legal administrative procedures whose disputes fall within the jurisdiction of ordinary or administrative judicial bodies other than the competent judicial body. The application of this theory is fair and correct. Its correct application to the Algerian judicial system eliminates the erroneous and impossible attempts to apply the condition of non-existence of parallel action stipulated in Article 276 of the Algerian Code of Civil Procedure to the admissibility of an annulment claim. This prompted the Algerian legislator to remove its mention in the new Code of Civil and Administrative Procedure. | |
