| dc.description.abstract | يهدف هذا المقال البحثي إلى دراسة موضوع آليات الحماية الإجرائية للطفل محل الاستغلال الاقتصادي المقررة في القانون الجزائري. سواء عندما يتعلق الأمر بإقرار هذه الآليات في إطار علاقة العمل في ظّل مُختلف النّصوص المنظمة لعلاقات العمل، أو خارج نطاق هذه العلاقة باعتبار أنّ الطفل موضوع الاستغلال الاقتصادي يدخل ضمن فئة الطفل في حالة خطر طبقا للمادة02 من القانون رقم15/12 المتعلق بحماية الطفل. وعلية فإشكالية هذه الدراسة تتمحور حول مدى نجاعة هذه الآليات في الحد من هذه الظاهرة من ناحية، ومن ناحية أخرى هل نجح المشرع الجزائري من خلال هذه النصوص في محاكاة الاتفاقات الدولية كاتفاقية حقوق الطفل لسنة1989 والتي اعتبرت حماية حقوق الطفل من الاستغلال الاقتصادي من بين أهم الحقوق التي ينبغي أن يتمتع بها. This research article aims to study the subject of procedural protection mechanisms for the child in the field of economic exploitation established in Algerian law. Whether when it comes to approving these mechanisms within the framework of the labor relationship in light of the various texts regulating labor relations, or outside the scope of this relationship, given that the child subject to economic exploitation falls under the category of the child in danger according to Article 02 of Law N 15/12 related to child protection. As a result, the problem of this study is based first and foremost on the extent to which these mechanisms are effective in limiting this phenomenon. Second, has the Algerian legislator succeeded in simulating international agreements such as the 1989 Convention on the Rights of the Child, which considered the protection of children's rights from economic exploitation to be among the most important rights that they should have? | |
