| dc.description.abstract | إن العلاقة بين المحكمة الجنائية الدولية ومجلس الأمن التابع للأمم المتحدة تتسم بالتفاعل والتعقيد. فبموجب الفصل السابع من ميثاق الأمم المتحدة، يستطيع مجلس الأمن إحالة القضايا إلى المحكمة الجنائية الدولية، حتى ولو لم تكن الدول المعنية طرفاً في نظام روما الأساسي. كما يستطيع المجلس تأجيل تحقيقات المحكمة الجنائية الدولية لفترات مدتها 12 شهراً قابلة للتجديد. ومع ذلك، تظل المحكمة الجنائية الدولية كياناً مستقلاً لا يخضع مباشرة لمجلس الأمن. وتعكس هذه العلاقة توازن القوى بين الحفاظ على العدالة الجنائية الدولية ومعالجة الاعتبارات السياسية والأمنية العالمية التي يتعامل معها مجلس الأمن. The relationship between the ICC and the UN Security Council is complex and interactive. Under Chapter VII of the UN Charter, the Security Council can refer cases to the ICC, even if the states in question are not parties to the Rome Statute. The Council can also defer ICC investigations for renewable periods of 12 months. However, the ICC remains an independent entity that does not report directly to the Security Council. This relationship reflects the balance of power between preserving international criminal justice and addressing the global political and security considerations that the Security Council deals with. | |
