Abstract
تعتبر التعددية الحزبية من أهم مظاهر الديمقراطية، ولممارسة هذه التعددية لابد من وضع ضوابط تحكمها، تتجسد في ما تسنه السلطة التشريعية من قوانين تمارس الأح ا زب مهامها وفقا لها. عرفت الجزائر العمل الحزبي وأقرت به من خلال دستور 1989 والذي تم تكريس ما جاء به من خلال صدور القانون1989 والمتضمن قانون الجمعيات ذات الطابع السياسي، والذي صرح /07/ 11 المؤرخ في 05 - رقم 89بإنشاء الجمعيات ذات الطابع السياسي. إلا أن المشرع الج ا زئري توسع إلى غير ذلك من خلال القانون09 الذي تضمن الأسس الواجب إتباعها لإنشاء الأح ا زب السياسية، في حين يرى بعض - العضوي 9709 فيها قيود - الفقهاء أن إنشاء أو تأسيس الأح ا زب السياسية حسب ما جاء في مواد القانون العضوي 97 لحرية تجسيد تعددية حزبية حقيقية. وو ا رء سعي المشرع للتجسيد الأمثل للممارسة الحقيقية للتعددية الحزبية صدر القانون العضوي١٢/ المتعلق بالاحزاب السياسية، إذ تضمن في مواده شروط وطرق إنشاء الأحزاب السياسية وتنظيمها. فإذا كان هذا القانون حدد الشروط الواجب إتباعها لإنشاء الأح ا زب السياسية، فهل تضمن كذلك النظام القانوني لها، وهو موضوع دراستنا: "النظام القانوني للأحزاب السياسية في الجزائرPolitical pluralism is considered one of the most prominent manifestations of democracy. TPolitical pluralism is a hallmark of democracy. To give effect to this pluralism, it was necessary to establish regulatory frameworks—embodied in laws enacted by the legislative authority—within which political parties could operate. Algeria adopted and enshrined multiparty pluralism in its 1989 Constitution; the constitutional provisions were given institutional form through the enactment of Law No. 89-11 of July 5, 1989, concerning associations of a political nature, which authorized the establishment of such entities. However, the Algerian legislator subsequently expanded this scope through Organic Law No. 97-09, which defined the requirements for founding political parties. Conversely, some legal scholars argue that the procedures for establishing political parties, as set forth in Organic Law No. 97-09, impose restrictions on the freedom to achieve genuine political pluralism. In an effort to better realize effective political pluralism, the legislator enacted Organic Law No. 12-04 on political parties, which outlined the conditions and procedures for their establishment and organization. While this law defined the preliminary requirements for founding parties, the question remains as to whether it also encompasses their broader legal framework—the subject of the present study: "The Legal Framework of Political Parties in Algeria."
