| dc.description.abstract | تعتبر العقود العمومية من أهم العقود الإدارية، وذلك لأهمية الدور الذي تلعبه. وهي الوسيلة الفعالة التي تتعامل بها الإدارة المتعاقدة مع المتعاملين الآخرين لتأمين الحاجات العامة. وتتميز العقود العمومية عن كافة العقود الأخرى المدنية والتجارية وعقود الشغل.67 ومن خلال دراستنا لتنفيذ العقود العمومية في ضوء أحكام القانون 23-12 نستنتج أن: أثناء إبرام الصفقة، تتمتع الجهة المتعاقدة بسلطة إعداد دفتر الشروط حسب تقديرها، ثم تحيله إلى لجنة المشتريات المختصة للموافقة عليه. من خلال سلطتها في المراقبة قبل إبرام الصفقة. نستنتج أيضا أن الموقف القانوني للجهة المتعاقدة في إبرام الصفقة يكون في موقف ضعف تجاه مصلحة التعاقد عندما تستغل السلطات والصلاحيات. والامتيازات الكبيرة الممنوحة لها سواء في مرحلة إبرام الصفقة أو التنفيذ.Public contracts are considered among the most important administrative contracts, due to the importance of the role they play. They are the effective means by which the contracting administration deals with other stakeholders to secure public needs. Public contracts are distinguished from all other civil, commercial and employment contracts.67 Through our study of the implementation of public contracts in light of the provisions of Law 23-12, we conclude that: During the conclusion of the deal, the contracting party has the authority to prepare the specifications according to its discretion, Then refer it to the competent purchasing committee for approval. Through its authority to monitor before concluding the deal. We also conclude that the legal position of the contracting party in concluding the deal is in a weak position towards the contracting interest when it exploits the powers and authorities.
