dc.description.abstractيُعد قاضي التحقيق من أهم الفاعلين في مرحلة التحقيق الابتدائي، لما يتمتع به من صفة قانونية خاصة تجعله حلقة وصل بين النيابة العامة ومحاكم الموضوع. وقد نظم المشرع الجزائري مهامه بتحديد خصائصه وشروط تعيينه وطبيعة اختصاصه القضائي، سواء من حيث الاختصاص المكاني أو الموضوعي. كما حدد الإجراءات القانونية التي يخول له بموجبها الارتباط بملف القضية. كما منحه سلطة إصدار أوامر مختلفة، منها ما هو تحفظي ووقائي لضمان حسن سير التحقيق، ومنها ما هو مرتبط بنتائج القضية، كأوامر الإحالة أو أوامر عدم جواز المتابعة. وتخضع هذه الأوامر للمراجعة القضائية عبر آلية الاستئناف أمام غرفة الاتهام، التي تمارس الرقابة القانونية لضمان حماية حقوق الأطراف.The investigating judge is considered one of the most important actors in the preliminary investigation phase, as he holds a special legal status that positions him as a link between the Public Prosecution and the trial courts. The Algerian legislator has regulated his functions by defining his characteristics, the conditions for his appointment, and the nature of his judicial jurisdiction, whether in terms of territorial or subject-matter competence. In addition, the legislator has specified the legal procedures through which he is authorized to be connected to the case file. He is also granted the authority to issue various orders, some of which are precautionary and preventive to ensure the proper conduct of the investigation, and others related to the outcome of the case, such as referral orders or orders of no grounds for prosecution. These orders are subject to judicial review through an appeal mechanism before the Indictment Chamber, which exercises legal oversight to ensure the protection of the parties' rights.
