| dc.description.abstract | لقد كانت هذه الدراسة محاولة جادة للإحاطة بموضوع: دعو ى إلتماس إعادة النظر في قانون الإجراءات المدنية والإدارية، وذلك من خلال بيان مفهوم إلتماس إعادة النظر على إرساء العدالة ومشروعيته، ثم إظهار أهم حاالته وكذا إجراءاته، ولقد اعتمدنا في هذه المذكرة على كل من المنهج الوصفي، والمقارن، والتحليلي.حيث أن الطعن بالتماس إعادة النظر يشكل طريقا هاما من طرق الطعن غير العادية أمام الجهات القضائية في التشريع الجزائري، بغية تحقيق مضامين المحاكمة العادلة، وإعطاء الخصوم فرصة لمراجعة الأحكام القضائية متى توصل الأطراف إلى أن القضاة بنو حكمهم على وثيقة مزورة، أو على وثيقة حاسمة كانت محتجزة لدى الخصم، كما وحاولنا الوقوف على جزئيات عديدة تمثلت في التطرق للجانب الموضوعي وكذا الإجرائي لهذا الموضوع.This study was a serious attempt to cover the topic of the petition for reconsideration of the Code of Civil and Administrative Procedure. This was achieved by clarifying the concept of petition for reconsideration in the establishment of justice and its legitimacy, then highlighting its most important cases and procedures. In this memorandum, we relied on the descriptive, comparative, and analytical approaches. Appealing a petition for reconsideration constitutes an important form of extraordinary appeal before judicial bodies in Algerian law, with the aim of achieving the principles of a fair trial and providing litigants with an opportunity to review judicial rulings when they conclude that judges based their ruling on a forged document or on a crucial document held by the litigant. We also attempted to address numerous details, including the substantive and procedural aspects of this topic. | |
