| dc.description.abstract | يجوز للمتهم الذي صدر ضده حكم عسكري أن يلجأ إلى إحدى طرق الطعن التي صنفها المشرع إلى طرق عادية وغير عادية. أما الطرق العادية في استئناف الأحكام الصادرة عن المحاكم العسكرية، فهي الطرق التي يلجأ إليها الشخص من أجل إعادة النظر في الحكم الصادر ضده، وهذه الطرق هي المعارضة والاستئناف. ويطبق المعارضة على الأحكام الغيابية حصراً، أما الاستئناف فيلجأ إليه المتهم من أجل إحالة ملفه إلى جهة قضائية أعلى رتبة من تلك التي أصدرت الحكم لتنظر فيه من جديد. أما طرق الطعن غير العادية في الأحكام العسكرية فتتمثل بالنقض الذي يتم اللجوء إليه للنظر فيما إذا كانت المحكمة العسكرية قد طبقت النصوص والمبادئ القانونية تطبيقا سليما أم لا، والطعن لصالح القانون الذي شرعه القانون في حفاظاً على حقوق الإنسان وضمان حسن سير العدالة، ومن ثم طلب إعادة النظر. إنها آخر طريقة غير عادية للاستئناف. The accused against whom a military ruling was issued may resort to one of the methods of appeal that the legislator has classified into ordinary and extraordinary methods. As for the normal methods of appealing judgments issued by military courts, they are the methods that a person resorts to in order to reconsider the ruling issued against him, and these methods are opposition and appeal. Opposition is applied exclusively to judgments in absentia, while appeal is used by the accused in order to transfer his file to a judicial authority higher in rank than the one that issued the ruling in order to consider it again. As for the unusual methods of appeal against military rulings, they arerepresented by cassation, which is resorted to to consider whether the military court has applied the legal texts and principles properly or not, and appeal in favor of the law that the law has enacted in order to preserve human rights and ensure the proper administration of justice, and then seek reconsideration. It is the last unusual method of appeal. | |
