| dc.description.abstract | يعدّ البناء المخالف للتعمير من أهم المشاكل التي تعيق تطور المدينة الجزائرية، ولا يمكن حل والقضاء على هذه الظاهرة إلّا من خلال توسيع نطاق دراستها موضوعيا ومكانيا وزمنيا؛ وضبط توصيفها سواء ما تعلق بمادية البناية أو بجريمة القيام بأشغال البناء في حدّ ذاتها، الأمر الذي يستدعي الاعتماد على مفاهيم ومسائل من فروع القانون الأخرى العام أو الخاص تخدم في جوهرها موضوع محل الدراسة من من نواحي عديدة أهمها ما تعلق بالتكييف القانوني للبناء المخالف للتعمير. وقد توصلنا إلى نتائج أهمها هو أن الهدف المتوخي من قانون 08-15 ليس القضاء على مشكلة البناء المخالف للتعمير بشكل نهائي، كما يعتقد الكثير، بل معالجة للنتائج دون الأسباب، لكون هذه الأخيرة ما زالت قائمة نتيجة عدم التكامل بين المعطيات الاقتصادية والاجتماعية والثقافية والقانونية في البلد. فالتعمير في الدول المتخلفة يتقدم خطوة نحو الأمام وخطوة أخرى نحو الخلف بسبب ظاهرة البناء المخالف للتعمير، على خلاف التعمير في الدول المتقدمة يتقدم بخطوات ثابتة نحو الأمام. The construction contrary to urbanism is one of the most important problems that hinder the development of the Algerian city, and this phenomenon can only be solved and eliminated by expanding the scope of its study objectively, spatially and temporally; And adjusting its description, whether related to the material of the building or the crime of carrying out construction works per se, which calls for reliance on concepts and issues from other branches of public or private law, because it serves in essence the subject of the study in many respects related to the legal adaptation of the building in violation of urbanism. We have reached results, the most important of which is that the objective of Law 15-08 is not to completely eliminate the problem of unconstructed construction, as many believe, but rather to address the consequences without the reasons, because the latter still exists as a result of the lack of integration between the economic, social, cultural and legal data in Country. The reconstruction in the underdeveloped countries is progressing one step forward and another step backward due to the phenomenon of construction contrary to the reconstruction unlike construction in developed countries, it is progressing steadily forward. | |
