| dc.description.abstract | نتناول في هذا المقال أهم الإشكاليات القانونية الموضوعية و الإجرائية التي يثيرها الغبن في البيوع العقارية، و المتعلقة على الخصوص بدعوى الغبن التي يرفعها البائع المغبون لتكملة الثمن إلى أربعة أخماس القيمة الحقيقية للعقار وقت البيع، و دعوى الفسخ في حالة عدم إلتزام المشتري بتكملة الثمن، و من بينها تحديد طبيعة البيوع العقارية التي تكون محلا لدعوى الغبن، و وقت تقدير الغبن بالنسبة لبعض العقود، و مدى إمكانية إنتقال كل من دعوى الغبن و دعوى الفسخ إلى الورثة، و آجال رفعهما، و إجبارية شهرهما في السجل العقاري، و نحاول تسليط الضوء على الحلول القانونية و الفقهية و القضائية لمختلف هذه الإشكاليات. we deal by this article the most important substantive and procedural legal problems raised by lesion in real estate sales, and in particular related to actions for rescission for lesion raised by the injured seller to complete the price up to four fifths of the property at the time of sale, and the action for rescission in the case where the buyer does not undertake to complete the price, including the determination of the nature of the real estate sales that are the subject of the action for injury, the time limit for estimating the injury with respect to certain acts, the extent of the possibility of transferring both the action for injury and the action for rescission to the heirs, the time limits for filing them, and the constraint of their publication in the land register, we try to attempts to highlight the legal, jurisprudential and judicial solutions to these various problems. | |
