Résumé
La qualité de la traduction est étroitement liée au niveau du traducteur et à sa culture. En outre, les textes qui se caractérisent par des aspects culturels constituent de nombreuses contraintes pour le traducteur. C’est ce que nous voulons mettre en valeur, notamment en ce qui concerne les textes juridiques revêtus d’un langage de droit particulier, et porteurs de divers aspects culturels.
Nous avons abordé, à travers cette étude, la problématique du transfert de l’aspect culturel des actes juridiques, en prenant comme modèle "Acte de habous" du traducteur Mohamed Tiar. On s’interrogera, alors, sur la réussite de l’opération traduisante et du transfert de toutes les spécificités culturelles, religieuses et sociales de ce concept, vers la langue française? Afin de mieux cerner cette problématique, nous avons opté pour une étude analytique crtique. En débutant cet article par des notions théoriques s’y rapportant pour en aboutir au corpus et à l’analyse de la traduction.

The quality of translation is closely linked to translator’s level and culture. Moreover, texts which are characterized by cultural aspect constitute many constraints for translators. That’s what we wanted to highlight, especially with regard to legal texts, which are covered with law language and bearing various cultural aspects. We will discuss, through this paper, the problem of transferring cultural aspect of legal acts, taking as a model "Act of habous" translated by Mohamed Tiar. We will then wonder about the success of the translating operation and about the transfer of all cultural, religious and social specifities into the French language? In order to well understand this problem, we opted for an analytical and critical method and we thought suitable to start this article with theoretical notions relating to it, to arrive at the corpus and translation analysis.
