| dc.description.abstract | تتناول هذه المذكرة موضوع الخبرة القضائية كوسيلة من وسائل اإلثبات في المجال الجنائي ، حيث تمثل آداة فنية يعتمد عليها القضاة لفهم وقائع فنية او تقنية تحتاج إلى معرفة علمية متخصصة اليملكها القاضي ، فالخبرة القضائية تستند إلى أشخاص مختصين يطلق عليهم إسم "الخبراء" . يقوم الخبير المختص بإعداد تقرير يساعد المحكمة في تكوين قناعتها لكن هذا التقرير الذ يلزم القاضي الذي يبقى له سلطة تقديرية في قبوله أو رفضه . تلعب الخبرة دورا مهما في كشف الحقيقة إال أنها تخضع لضمانات قانونية أهمها الحياد ، قابلية التقرير للمناقشة ، وإمكانية إج ارء خبرة مضادة . ولقد نظم المشرع الجزائري قواعد الخبرة في قانون الاجراءات الجزائية من المادة 143 إلى 156.This memorandum addresses the subject of judicial expertise as a means of proof in the criminal field. It represents a technical tool relied upon by judges to understand technical or technological facts that require specialized scientific knowledge not possessed by the judge. Judicial expertise relies on specialized individuals known as "experts." The specialized expert prepares a report that helps the court form its convictions. However, this report is binding upon the judge, who retains the discretion to accept or reject it. Expertise plays an important role in uncovering the truth, but it is subject to legal guarantees, most notably impartiality, the report's openness to discussion, and the possibility of conducting a counter-expertise. The Algerian legislator has regulated the rules of expertise in Articles 143 to 156 of the Code of Criminal Procedure. | |
