Abstract
يهدف هذا البحث إلى دراسة مكانة مجلس الدولة الجزائري في النظام القضائي الإداري، باعتباره جهة استئناف ونقض في آن واحد. وقد تم التطرق إلى صلاحياته كجهة استئناف من خلال مراقبة الأحكام الادارية المطعون فيها، ثم دوره كجهة نقض في توحيد الاجتهاد القضائي وضمان التطبيق السليم للقانون. ويبرز من خلال هذه الد ارسة الدور المحوري لمجلس الدولة في تكريس المشروعية وتعزيز العدالة الإدارية في الجزائر.This study aims to analyze the role of the Algerian Council of State within the administrative judicial system, as both a court of appeal and a court of cassation. It addresses its appellate function through the review of contested administrative judgments, and its cassation function in unifying jurisprudence and ensuring the proper application of law. The research highlights the central role of the Council of State in upholding legality and strengthening administrative justice in Algeria.
