| dc.description.abstract | تهدف هذه الدراسة إلى تسليط الضوء على مشروعية القرارات الإدارية في التشريع الجزائري، حيث يعد مبدأ المشروعية من أهم عناصر الدولة القانونية الحديثة ويمثل ضمانة قوية منحها المشرع للأفراد للحفاظ على حقوقهم ومصالحهم. يعيش من تجاوزات الإدارة. وتشترط صحة القرار الإداري وقانونيته مطابقته لتصرفات الإدارة وتصرفاتها مع القانون، وكذلك عدم المساس بكرامة الإدارة حيث تمثل هذه الأركان شرعية القرار. إلا أن هناك حالات استثنائية تمكن الإدارة من الخروج عن قواعد الشرعية وتوسيع صلاحياتها دون الإخلال بأهداف الحكم مع خضوعها للرقابة للتأكد من عدم تجاوز الهيئة الإدارية لبعض القرارات ضد الأفراد.This study aims to shed light on the legality of administrative decisions in Algerian legislation, since the principle of legality is one of the most important elements of the modern legal state and represents a strong guarantee granted by the legislator to individuals to preserve their rights and their lives from the abuses of the administration. The validity and legality of the administrative decision requires conformity with the actions of the administration and its actions with the law, as well as not prejudicing the dignity of the administration Where these pillars represent the legitimacy of the decision. However there are exceptional cases that enable the administration to deviate from the rules of legality and expand its powers without prejudice to the ruling objectives while being subject to oversight to ensure that the administrative body does not transgress certain decisions against individuals. | |
