| dc.description.abstract | موضوع "نهاية القرار الإداري" تم عرضه من خالل د ارسة تحليلية ثنائية المحور؛ُخصص الفصل الأول لبحث اإلنهاء اإلداري للق ارر اإلداري، الذي يتم إما عن طريق سحب الق ارر غير المشروع أو إلغائه، تحقيًقا للمصلحة العامة، مع الالتزام بالضوابط القانونية التي تحمي الحقوق المكتسبة أما الفصل الثاني فقد تناول الإنهاء القضائي للقرار الإداري، الذي يتم من خلال دعوى الإلغاء أمام القضاء الإداري، الذي يختص برقابة مشروعية القرار، ومن هنا يتجلى دور كل من الإدارة والقضاء في تنظيم وإنهاء القرارات الإدارية. وبذلك، تُعد نهاية القرار الإداري وسيلة لضمان المشروعية وتحقيق التوازن بين السلطة الإدارية وحقوق الأفراد.The topic of "The Termination of an Administrative Decision" was presented through a dual-axis analytical study. The first chapter was devoted to examining the administrative termination of an administrative decision, which occurs either by withdrawing or annulling the unlawful decision, in the public interest, while adhering to the legal controls that protect acquired rights. The second chapter addressed the judicial termination of an administrative decision, which occurs through a cancellation lawsuit before the administrative judiciary, which is responsible for monitoring the legality of the decision. This highlights the role of both the administration and the judiciary in regulating and terminating administrative decisions. Thus, the termination of an administrative decision is a means of ensuring legitimacy and achieving a balance between administrative authority and individual rights. | |
