| dc.description.abstract | تأسيسا على المكانة الدستورية التي أضحت تحوزها البيئة كقيمة إنسانية بالجزائر بموجب التعديل الدستوري الأخير لسنة 2020، وانطلاقا من التوجه الاقتصادي الجديد للدولة والذي يرمي إلى تحريك الآلة الصناعية من خلال تشجيع الاستثمار في القطاع الصناعي، وللوقوف تبعا لذلك على الأنظمة القانونية المعتمدة لتحقيق التوازن بين متطلبات المحافظة على البيئة ومستلزمات التنمية الاقتصادية في شقها الصناعي، فإننا نهدف من وراء هذه الدراسة إلى البحث في طبيعة الأنظمة القانونية ذات الطابع التقني الممنوحة للإدارة لتحقيق التوازن المنشود ومجابهة الأخطار والأضرار المرتبطة والناجمة عن أفعال التلوث الصناعي للبيئة، والبحث في مدى إدراك المشرع الجزائري لتلك الأخطار والأضرار وما تشترطه من قواعد حماية قانونية وقائية خاصة. Based on the constitutional position that the environment has become as a human value in Algeria according to the latest constitutional amendment of 2020, and based on the new economic orientation of the state, which aims to move the industrial machine by encouraging investment in the industrial sector, and to stand accordingly on the legal systems adopted to achieve a balance between the requirements of the province On the environment and the requirements of economic development in its industrial part, we aim behind this study to research the nature of legal systems of a technical nature granted to the administration to achieve the desired balance and confront the dangers and damages associated with and resulting from acts of industrial pollution of the environment, and to research the extent to which the Algerian legislator is aware of these dangers and damages and what It is required by special protective legal rules. | |
