| dc.description.abstract | يعتبر الإبراء من الدين من المسائل التي اهتم بها الفقهاء المسلمون وعنت بها مختلف التشريعات الوضعية ومنها التشريع الجزائري، الذي خصص لها المادتين 305 و 306 من القانون المدني للحديث عن طبيعة هذا التصرف وسماته وشروطه وأنواعه والآثار الناجمة عن الإقدام عليه. لذلك جاءت هذه الورقة البحثية لتميط اللثام عن موضوع أحكام الإبراء من الدين في دراسة بين أحكام الفقه الإسلامي والتشريع الجزائري. Exemption from religion is one of the issues that Muslim jurists have taken care of and dealt with by various man-made legislations, including the Algerian legislation, for which Articles 305 and 306 of the Civil Code are devoted to talking about the nature of this behavior, its features, conditions, types, and the effects resulting from undertaking it. Therefore, this research paper came to unveil the subject of the provisions of the exoneration of religion in a study between the provisions of Islamic jurisprudence and Algerian legislation. | |
