Abstract
يتناول هذا البحث المحاكم الإدارية الاستئنافية في الجزائر من خلال تحليل إطارها المفاهيمي والقانوني، مع تسليط الضوء على تطور القضاء الإداري الاستئنافي، لا سيما في أعقاب التعديل الدستوري الأخير. كما تبحث الدراسة في الأسس الدستورية والقانونية لهذه المحاكم، وتُحلل اختصاصاتها، وتنظيمها الداخلي، وإجراءات الطعن أمامها.
وتخلص الدراسة إلى أن إنشاء المحاكم الإدارية الاستئنافية يُرسّخ مبدأ التقاضي على درجتين، ويعزز حماية الحقوق والحريات في المنازعات الإدارية. ومع ذلك، تظل فاعلية هذه المحاكم مرهونةً بالتطبيق السليم للنصوص القانونية وتوافر الموارد اللازمة.This research examines administrative appellate courts in Algeria by analyzing their conceptual and legal framework, while highlighting the evolution of administrative appellate justice—particularly following the recent constitutional amendment. The study explores the constitutional and legal foundations of these courts, analyzes their jurisdiction and internal organization, and examines the procedures for lodging appeals before them.
The study concludes that the establishment of administrative appellate courts reinforces the principle of two-tiered litigation and enhances the protection of rights and freedoms in administrative disputes. Nevertheless, the effectiveness of these courts remains contingent upon the proper application of legal provisions and the availability of necessary resources.
