Abstract
تتكون الجماعات الإقليمية في الجزائر من قسمين ( البلدية- الولاية) , يعتبر الوالي السلطة الأساسية في الولاية, و يشكل محور كل السياسيات و البرامج التي تنفذها الدولة على مستوى الولاية, تنفيذا لذلك يصدر قرارات إدارية تمس جميع المجالات و التي من شأنها المساس بالمراكز القانونية للأفراد, نتناول في هذه الدراسة حالة من بين الحالات التي يتدخل فيها القاضي الإداري لحماية حقوق و حريات الأفراد من القرارات الإدارية التي يصدرها الوالي, و التي تكون مشوبة بعيب مخالفة القانون, مع عرض تطبيقات من القضاء الإداري الجزائري.
The Algerian administrative divisions are composed of two levels: the communes and the wilayas, the wali is the fundamental authority in the province ,He represents the hub of all the policies and the programs which executed and implemented by the State , he has the ability to set administrative decisions which might affect the legal status of individuals. In this case we will concern our study with some legal circumstances in which the administration law judge intervenes to protect individuals’ rights and liberties from flaw hiked decisions issued by the wali in term of law violation ,and finally we present some applications of the administrative jurisdiction in Algeria.
