Abstract
تتناول هذه الد ارسة موضوع الجريمة الجمركية في التشريع الجزائري، باعتبارها من أخطر الجرائم الإقتصادية التي تهدد الإقتصاد الوطني وتضعف من قدرة الدولة على حماية أسواقها. تهدف الدراسة إلى تسليط الضوء على الإطار القانوني الذي وضعه المشرع الجزائري لمكافحة هذه الظاهرة، من خلال تحليل الأحكام الواردة في قانون الجمارك، والقانون رقم 06/05 المتعلق بمكافحة التهريب . كما تم التطرق إلى الآليات الأمنية والشرطية )كالانتربول والافريبول( والقضائية كالإنابة والتعاون الدولي( التي تدعم مكافحة هذه الجريمة على المستويين الوطني والدولي. وخلصت الدراسة إلى أن المنظومة القانونية الحالية تحتاج إلى تطوير مستمر، خاصة أمام تطور أساليب التهريب وتعقيد شبكاته، مما يستدعي تعزيز التنسيق والتحديث التشريعي والتقنيThis study addresses the topic of customs crime in Algerian legislation, as it is considered one of the most serious economic crimes that threaten the national economy and weaken the state's ability to protect its markets. The study aims to shed light on the legal framework established by the Algerian legislator to combat this phenomenon, by analyzing the provisions contained in the Customs Law and Law No. 06/05 on combating smuggling. It also addresses security and police mechanisms (such as Interpol and Afripol) and judicial mechanisms (such as representation and international cooperation) that support the fight against this crime at the national and international levels. The study concludes that the current legal system needs continuous development, especially in light of the development of smuggling methods and the complexity of its networks, which calls for strengthening coordination and legislative and technical modernization.
