Abstract
في ظل التطور التكنولوجي الحاصل أمكن إبرام المعاملات ضمن وسائل الاتصال الحديثة، لكن هذا المجال في التعاقد خلق إشكالات قانونية تتمثل في هوية المتعاقدين الحقيقية، ذلك أن التعاقد يتم بين شخصين غائبين أو افتراضيين دون الحضور المادي لهما. إن أهلية الأطراف المتعاقدة عبر وسائل الاتصال الإلكترونية تحدد بالتوقيع الالكتروني هذا الأخير يقوم بأداء وظيفتين، من جهة هي أداة تعريف بهوية أطراف المعاملة الإلكترونية، ومن جهة أخرى تعبير عن الإرادة ونسبة مضمون المحرر إليه، لكن يبقى التوقيع الالكتروني دون قيمة ما لم يتم التأكد من نسبته لصاحبه، فتبرز هيئات التصديق الإلكتروني التي تلعب دورا كبيراً من خلال توفير بيئة إلكترونية آمنة ومضمونة للأفراد المتعاملين عبر شبكة الإنترنت إذ تمثل عنصر الموثوقية فهي من تصدِّق على التواقيع الالكترونية.
In light of the technological development taking place, it was possible to conclude transactions within modern means of communication, however, this field of contracting created legal problems represented in the real identity of the contractors, this is because the contract is between two absent or hypothetical persons without the physical presence of them. The eligibility of the contracting parties through electronic means of communication is determined by the electronic signature. The latter performs two functions, on the one hand, it is a tool for identifying the parties to the electronic transaction, On the other hand, it is an expression of the will and the ratio of the editor's content to it, However, the electronic signature remains without value unless its attribution to its owner, is confirmed the electronic certification bodies, which play a major role by providing a safe and secure electronic environment for individuals transacting via the Internet, It represents the element of reliability as they certify electronic signatures.
