Abstract
تناولت هذه الدراسة دور المحكمة الدستورية الجزائرية في حماية الحقوق والحريات كأهم ما جاء في التعديل الجديد لدستور سنة 2020، وذلك من خلال تقديم تعريف لها حسب التعديل، وإلقاء نظرة في جذورها التاريخية وبيان تكوينها وأهم الشروط التي دعمتها من قبل المؤسس الدستوري، خاصة تلك المتعلقة بكيفية الحصول على العضوية داخل المحكمة الدستورية وضمان استقلالها، بالإضافة إلى التركيز على توسيع نطاق اختصاصاتها، وتحليل أثر المحكمة الدستورية في الحفاظ على حقوق الأفراد وحرياتهم، وتقديم النظرة المستقبلية للمحكمة وعوامل نجاحها في المهام المنوطة بها في مراقبة دستورية القوانين، وهو ما يعتبر تطوراً دستورياً وديمقراطياً. ومهما كان الأمر فإنه يجب الحفاظ عليه وتنفيذ أحكامه، خاصة تلك المتعلقة بعدم دستورية القوانين، وذلك لضمان سيادة الدستور ودعم شرعيته والحفاظ على حقوق الأفراد وحرياتهم.This study dealt with the role of the Algerian Constitutional Court in protecting rights and freedoms as the most important thing that came in the new amendment to the constitution of the year 2020, by providing a definition of it according to the amendment, and taking a look at its historical roots and showing its formation and the most important conditions that it was supported by by the constitutional founder, Especially those related to how to gain membership within the Constitutional Court and ensure its independence, in addition to focusing on expanding its jurisdiction, analyzing the impact of the Constitutional Court in preserving the rights and freedoms of individuals, and presenting a future view of the Court and its success factors in the tasks entrusted to it in monitoring the constitutionality of laws, which is considered a constitutional and democratic development. No matter what, it must be preserved and its provisions must be implemented, especially those related to the unconstitutionality of laws in order to ensure the supremacy of the constitution, uphold its legitimacy, and preserve the rights and freedoms of individuals.
