| dc.description.abstract | تتناول هذه المذكرة موضوع طرق الإثبات في المادة الجزازئية و التي يقصد بها تلك الطرق التي حددها القانون للوصول إلى كشف الحقيقة المتعلقة بالواقعة الإجرامية و نسبتها للمتهم و تسليط العقوبة عليه. نستطيع القول أن موضوع الإثبات يرتكز على أمرين أساسيين: الأول يتمثل في تحقيق العدالة الجنائية للمتضرر من الجريمة، و الثاني يساعد القاضي في أن يصيب الحقيقة في حكمه سواء بالإدانة أو بالبراءة. تم تقسيم هاته الطرق إلى طرق تقليدية تتمثل في الإعتراف و الشهادة و الإستجواب، و طرق حديثة تتمثل في أدلة بيولوجية كالدم و البصمة الوراثية، و أدلة مستنبطة من حياة الانسان الخاصة كتسجيل الصوت و التقاط الصور، اعتراض المراسلات و التسرب.This memorandum addresses the subject of methods of proof in criminal law, which refers to the methods defined by law to uncover the truth related to a criminal incident, attribute it to the accused, and impose a penalty on him. We can say that the subject of proof is based on two fundamental principles: the first is achieving criminal justice for the victim of the crime, and the second helps the judge arrive at the truth in his ruling, whether convicting or acquitting. These methods are divided into traditional methods, represented by confession, testimony, and interrogation; modern methods, represented by biological evidence such as blood and DNA; and evidence derived from a person's private life, such as audio recording, photographing, intercepting correspondence, and leaks. | |
