| dc.description.abstract | ارتفاع مستوى التقاضي المحيط به، وقد تم إيلاء اهتمام خاص لوضع قواعد محددة لإثبات ملكية العقارات. وخلال فترة الانتقال من النظام الشخصي إلى النظام الحقيقي، تنوعت وسائل إثبات الملكية وكان تطبيق القانون المستندي جزءا من هذه العملية، رغم أن قانون التوثيق كان يشترط شكلية في العقود التي تثبت الملكية العقارية، إلا أن القضاء الجزائري وقد أظهر النظام اختلافات في تفسيره وتطبيقه في بعض الحالات. وتسبب هذا التناقض في اهتزاز الثقة في القطاع العقاري وتصاعد الخلافات التي استغرق حلها وقتا. لكن الوضع القانوني توطد أخيرا، مما سلط الضوء على بطلان العقود العرفية، وضرورة وجود إجراء شكلي لإثبات ملكية العقار.high level of litigation surrounding it, special attention was paid to establishing specific rules to prove real estate ownership. During a period of transition from the personal system to the real system, the means of proving ownership diversified and the application of documentary law was part of this process. Although the law on notarization required formality in contracts confirming real estate ownership, the Algerian judicial system showed divergences in its interpretation and application in some cases. This gap caused a shaken confidence in the real estate sector and an escalation of disputes that took a long time to be resolved. However, the legal situation was finally consolidated, highlighting the invalidity of customary contracts and the need for formality to prove real estate ownership. | |
