Abstract
الطب مهنة علمية وأخلاقية نبيلة، تقوم على أساس العلاقة بين المريض والطبيب. ويُعتبر الطبيب مسؤولاً، إذ تُعدّ المسؤولية الطبية من أهمّ المواضيع القانونية. يُطلب من الطبيب رعاية المريض وتوفير العناية اللازمة التي تُمليها المهنة الطبية. إذا لم يفعل الطبيب ذلك، فقد يُحاسب مدنياً، وربما جنائياً أيضاً. تُعتبر المسؤولية المدنية للطبيب تعاقدية متى وُجدت علاقة تعاقدية، وفي حالات استثنائية، قد تكون تقصيرية بطبيعتها. ويُحاسب الطبيب جنائياً إذا ارتكب خطأً أثناء ممارسته لمهنته. تخضع الأعمال الطبية لعدة شروط قانونية، منها الإذن القانوني، وموافقة الطبيب، ونية العلاج. في حال عدم استيفاء هذه الشروط، قد يُحاسب الطبيب جنائياً. وقد عالج المشرع هذه المسؤولية من خلال أحكام قانونية مُختلفة، والتي، على الرغم من فعاليتها النسبية، لا تزال بحاجة إلى تحديث لمواكبة التطورات في المجال الطبي.Medicine is a noble scientific and ethical profession, based on the relationship between patient and physician. Physicians are held responsible, as medical liability is one of the most important legal issues. Physicians are required to care for patients and provide the necessary care required by the medical profession. If they fail to do so, they may face civil and possibly criminal liability. A physician's civil liability is considered contractual whenever a contractual relationship exists, and in exceptional cases, it may be tortious in nature. A physician may be held criminally liable if they commit an error in the course of their professional practice. Medical procedures are subject to several legal conditions, including legal authorization, physician consent, and the intent to treat. If these conditions are not met, the physician may be held criminally liable. Legislators have addressed this liability through various legal provisions, which, despite their relative effectiveness, still need to be updated to keep pace with developments in the medical field.
