Abstract
الدعوى الإدارية هي وسيلة قانونية تهدف إلى المطالبة بالحقوق أو حمايتها، وتتطلب حضور الإدارة كطرف في هذا النوع من المنازعات. وللدعوى الإدارية خصائص تميزها عن غيرها من الدعاوى، وتتنوع هذه الدعاوى وتنقسم، ومن هذه الأنواع دعوى الإبطال، ودعوى التفسير، ودعوى فحص الشرعية، والدعوى القضائية الكاملة.
إن تنفيذ الإدارة للأحكام القضائية الصادرة ضدها طوعاً وفي المواعيد المحددة قانوناً يدل على احترامها لأحكام القضاء واحترامها لسلطة الحكم. وفي حالة عدم تنفيذها، فإنه من الضروري البحث عن وسائل تضمن الالتزام بمبدأ التنفيذ الإلزامي للقرارات القضائية الإدارية، وتتمثل هذه الوسائل في الأوامر القضائية والتهديد بالغرامات. كما يمكن توقيع عقوبات على الإدارة الممتنعة، مثل إلغاء قرارها الإداري المخالف للحكم، دون إغفال مسؤولية الموظف الممتنع عن التنفيذ.An administrative lawsuit is a legal means aimed at claiming or protecting
rights. It requires the presence of the administration as a party to this type of
dispute. An administrative lawsuit has characteristics that distinguish it from
other cases. These cases are varied and divided. These types include an
annulment lawsuit, an interpretation lawsuit, a lawsuit to examine legality, and
a full judicial lawsuit.
The implementation by the administration of the judicial rulings issued
against it voluntarily and within the legally specified time limits indicates that
the administration respects the judgments of the judiciary and respects the
authority of the ruling. In the event of its failure to execute, it is necessary to
seek means to ensure compliance with the principle of mandatory execution of
administrative judicial decisions. These means consist of judicial orders and
threatening fines. Penalties can also be imposed on the abstaining
administration, such as canceling its administrative decision contrary to the
ruling, without losing sight of the responsibility of the employee who abstains
from execution.
