| dc.description.abstract | تعتبر العقود الإدارية أداة لتنفيذ مخططات السياسة العامة للدولة، ويتجلى ذلك من خلال الاستعانة بها في إنجاز المشاريع التنموية الكبرى في جميع المجالات، وهو ما يدفع بالدول إلى ضخ رؤوس أموال ضخمة في سبيل تنفيذ هاته العقود، ما يجعل هذه الأخيرة أرضا خصبة لتفشي الفساد المالي والإداري، وذلك ما يزيد من أهمية البحث في اليات حل منازعات العقود الإدارية، لمنع الإدارة العامة من التعسف في استعمال امتيازاتها من جهة وحماية الطرف المتضرر من جهة أخرى. كأصل عام تخضع منازعات العقود الإدارية لرقابة القضاء الإداري، وبالإضافة إلى هذا الطريق الأصيل أجاز المشرع الجزائري بموجب قانون الإجراءات المدنية والإدارية للإدارة العامة إمكانية اللجوء للطرق البديلة لحل النزاعات، والمتمثلة في الصلح والوساطة القضائيين، ونظام التحكيم. Administrative contracts are considered a tool for implementing the state’s public policy plans, and this is evidenced by its use in the implementation of major development projects in all fields. Thisincreases the importance of researching mechanisms for resolving administrative contract disputes, to prevent the public administration from abuse of its privileges on the one hand, and to protect the aggrieved party on the other hand. As a general asset, administrative contract disputes are subject to the control of the administrative judiciary, and in addition to this original way, the Algerian legislator has permitted under the Civil and Administrative Procedures Law for the Public Administration the possibility of resorting to alternative methods of dispute resolution, represented in judicial conciliation and mediation, and the arbitration system. | |
