Abstract
تعتبر الرقابة على دستورية القوانين في العديد من الأنظمة المقارنة ومنها الجزائر أهم آليات حماية القواعد الدستورية ولذلك اسند الدستور الجزائري اختصاص هذه الرقابة إلى المجلس الدستوري الذي يتم تعيين أعضائه من طرف السلطات الثلاثة في الجزائر هذه الرقابة على أهميتها تخضع للعديد من العوامل التي تؤثر فيها رغم أنها محاطة بالعديد من الضمانات،ولعل أحد هذه العوامل المؤثرة تعيين أعضاء هذه المؤسسة الدستورية الرقابية المنصوص عليه ضمن المادة 164 من دستور الجزائر لسنة 1996
The control over the constitutionality of laws in many systems, including Algeria and the comparison of the most important mechanisms for the protection of constitutional rules and therefore the Algerian constitution affects the competence of this control, the Constitutional Council, which is established by members of the three authorities of Algeria. This control over the importance of the subject to many factors that affect them, although it is surrounded by a large number of guarantees, and perhaps one of the factors that influence the appointment of members of this constitutional control of institutions provided for in article 164 of the Constitution of Algeria 1996.
