| dc.description.abstract | يصدر القضاء الدولي الجنائي أحكام قضائية ضد مرتكبي الجرائم الدولية، وتنفيذها يكون في إحدى الدول التي تختارها المحكمة من خلال قائمة الدول التي أبدت رغبتها بتنفيذ العقوبة على أراضيها ، إلا أن الكثير من الدول تمتنع عن تنفيذها ، وبالتالي التأثير على تطبيق القانون الدولي الإنساني ، بحيث أن الحكم يبقى بدون تنفيذ ، أو أن ينفذ في دولة متساهلة مع المحكوم عليه ، أو متشددة وغير محترمة للقانون الدولي و القانون الدولي الإنساني ،وهو ما جعل الفقهاء يختلفون في آرائهم بين المؤيد و المعارض ، وكله رغبة في الحفاظ على تطبيق السلم و الأمن الدوليين في العالم .
