Abstract
لقد فتحت التكنولوجيا الرقمية بروز أنماط جديدة من التعاقدات والدخول في التزامات عبر شبكة الانترنت، أرست نظاما جديدا من الكتابة (التسجيل) والتوقيع، يتميزان بالطابع الالكتروني مما فرض تحول جذري في مجال إثبات العقد ومدى حجية التوقيع الالكتروني بعد أن كان يعتدّ كأولوية، على الكتابة الورقية والتوقيع الخطي، كما أن إبرام العقد في محيط افتراضي مدعاة لوقوع التوجس لدى الأطراف المتعاقدة، مما يستوجب وجود جهة تمنح الثقة لهم وتثبت الوجود القانوني للعقد.
With the help of internet, digital technology has brought about new methods of contracting and commitments between different parties. It has established a new system of writing and signing contacts electronically.
This development has brought about a radical shift in the field of ascertaining the validity of electronic contracts and signatures, in the past, the signing of contracts was mostly non-digital, such as the use of physical documentation.
The electronic writing and signing of contracts has brought about major concerns among contracting parties, among the major concerns raised, is the aspect of cyber security. This then brings about need of a legal body that confers confidence among contracting parties especially in terms of establishing the legal validity of the contract.
