| dc.description.abstract | تهدف هذه الورقة البحثية إلى إبراز الضمانات الإجرائية والموضوعية لمرحلة التحقيق من خلال النظام الأساسي للمحكمة الجنائية الدولية، والرامية لتكريس الحق في العدالة الجنائية في ظل التحديات القانونية التي تواجهه على غرار السلطة الممنوحة لمجلس الأمن في إرجاء أو تعليق التحقيق لمدة 12 شهر قابلة للتجديد لعدد غير محدد من المرات، كذلك الأمر بالنسبة للمدعي العام لتمتعه بسلطتي الإحالة والتحقيق في آن واحد، إضافة الى سلطته التقديرية الواسعة فيما يخص ارجاء مباشرة التحقيق في ظل عدم إمكانية استئناف قراراته، مما قد يعيق الحق في المحاكمة العادلة. This research paper aims to highlight the procedural and substantive guarantees of the investigation stage through the Statute of the International Criminal Court, which aims to establish the right to criminal justice in light of the legal challenges it faces, such as the authority granted to the Security Council to postpone or suspend the investigation for a period of 12 months, renewable for an unspecified number. Many times, the same applies to the public prosecutor, who enjoys the powers of referral and investigation at the same time, in addition to his wide discretion to postpone the commencement of the investigation in the absence of the possibility of appealing his decisions, which may impede the right to a fair trial | |
